These Terms and Conditions ("Terms") govern your use of the uklpa.co.uk website, operated by UKLPA Ltd (Company number 17114594), and our Lasting Power of Attorney (LPA) document preparation service. By accessing our website or using our service, you agree to be bound by these Terms.

Please read these Terms carefully before using our service. If you do not agree with any part of these Terms, you should not use our website or service.

2. About Our Service

UKLPA Ltd provides an online document preparation service that assists you in creating Lasting Power of Attorney documents in accordance with the Mental Capacity Act 2005 and the regulations set out by the Office of the Public Guardian (OPG).

Important: We Do Not Provide Legal Advice

Our service is a document preparation service only. We do not provide legal advice, and our service does not replace the need for independent legal advice where appropriate. We are not a firm of solicitors and are not regulated by the Solicitors Regulation Authority (SRA).

If you are unsure whether a Lasting Power of Attorney is suitable for your circumstances, or if your situation is complex, we recommend you seek independent legal advice from a qualified solicitor.

3. Eligibility

To use our service, you must:

  • Be aged 18 or over
  • Be a resident of England or Wales (our LPA documents are prepared under the law of England and Wales; Scotland and Northern Ireland have separate legal frameworks)
  • Have the mental capacity to create a Lasting Power of Attorney, as defined by the Mental Capacity Act 2005
  • Provide accurate and truthful information when using our service

4. Account Registration

To use our LPA preparation service, you must create an account. You are responsible for:

  • Providing accurate and up-to-date information during registration
  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately if you suspect any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

5. Our Service Process

Our LPA preparation service involves the following steps:

  1. Information Gathering: You provide the necessary details about the donor, attorneys, certificate provider, and any preferences or instructions through our online portal.
  2. Document Preparation: We use the information you provide to prepare your LPA document(s) in the format required by the Office of the Public Guardian.
  3. Review: Your completed LPA documents are made available for your review before printing.
  4. Signing & Witnessing: You are responsible for ensuring the LPA is signed and witnessed in the correct order, as required by law. We provide guidance on this process.
  5. Registration: The signed LPA must be registered with the Office of the Public Guardian before it can be used. The OPG charges a separate registration fee of £92 per LPA (correct at time of writing).

6. Your Responsibilities

When using our service, you agree to:

  • Provide complete, accurate, and truthful information. Inaccurate information may result in your LPA being rejected by the OPG.
  • Ensure that all persons named in the LPA (attorneys, certificate providers, people to notify) have given their consent to be included.
  • Follow the correct signing and witnessing procedures as outlined in our guidance and as required by law.
  • Understand that the LPA must be registered with the OPG before it can be used, and that registration is your responsibility.
  • Not use our service for any unlawful purpose or in any way that could damage, disable, or impair our website.

7. Pricing & Payment

Our fees for the LPA preparation service are displayed on our pricing page. All prices are stated in British Pounds Sterling (GBP) and are inclusive of VAT where applicable.

  • Payment is required before your LPA documents are generated.
  • We accept payment by major credit and debit cards. All payments are processed securely through our third-party payment provider.
  • Our fees cover the document preparation service only. They do not include the OPG registration fee, which is payable separately to the Office of the Public Guardian.
  • We reserve the right to change our pricing at any time. Any price changes will not affect orders that have already been paid for.

8. Refund Policy

We want you to be satisfied with our service. Our refund policy is as follows:

  • Before document generation: You may request a full refund at any time before your LPA documents have been generated.
  • After document generation: As our service involves the creation of personalised digital documents, your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 may be limited once the documents have been generated. However, we will consider refund requests on a case-by-case basis.
  • OPG rejection: If your LPA is rejected by the OPG due to an error on our part, we will correct the documents free of charge or provide a full refund.

9. Intellectual Property

All content on our website, including text, graphics, logos, designs, and software, is the property of UKLPA.co.uk or its licensors and is protected by UK copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on our website without our prior written consent. The LPA documents generated for you are provided for your personal use only.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Our service is provided on an "as is" basis. We make no warranties or representations regarding the suitability of an LPA for your specific circumstances.
  • We are not liable for any losses arising from inaccurate information provided by you, or from your failure to follow the correct signing and witnessing procedures.
  • We are not liable for any decision made by the Office of the Public Guardian regarding the registration of your LPA.
  • Our total liability to you in respect of all losses arising under or in connection with these Terms shall not exceed the amount paid by you for the service.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

UKLPA.co.uk is a document preparation service, not a law firm. We do not provide legal advice and are not a substitute for a qualified solicitor. The information on our website is provided for general guidance purposes only and should not be relied upon as legal advice.
